Terms of Service

These Terms of Service ("Terms") govern your use of the Pausis mobile application and website (pausis.com), operated by Pausis GmbH ("Pausis", "we", "us"), a company registered in Switzerland. By creating an account or using the service, you agree to these Terms.

1. Service Description

Pausis is a financial accountability tool designed to help individuals monitor and manage gambling behavior. The service:

• Connects to your bank account via Open Banking (Tink) to monitor transaction activity
• Detects transactions that may indicate gambling activity
• Alerts a designated trusted person ("Aniki") via SMS when incidents are detected or when you become inactive
• Tracks your clean-day streak

Pausis is not a medical, therapeutic, or clinical tool. It is not a substitute for professional help. If you or someone you know is struggling with gambling addiction, please contact a qualified professional or your national helpline.

2. Eligibility

• You must be at least 18 years old to use Pausis.
• You must have legal capacity to enter into a binding agreement.
• You must reside in a supported market where Tink Open Banking is available.

3. Account Registration

You may register using email/password, Apple Sign-In, or Google Sign-In. You are responsible for maintaining the security of your account credentials. You must provide accurate information and keep it up to date.

4. Consent to Monitoring

By connecting your bank account through Pausis, you explicitly consent to:

• Pausis accessing your transaction metadata (merchant name, amount, date, category code) via Open Banking
• Automated analysis of transactions to detect potential gambling activity
• SMS alerts being sent to your designated Aniki when incidents are detected
• SMS alerts being sent to your Aniki if you are inactive for more than 24 hours (Dead Man's Switch)

You may withdraw this consent at any time by revoking your bank connection in the app. Revoking consent will stop all monitoring and trigger a final notification to your Aniki informing them that monitoring has ended.

5. Aniki Role

By inviting an Aniki, you acknowledge that:

• Your Aniki will receive SMS alerts about detected gambling incidents (merchant name and amount may be included)
• Your Aniki will be notified if you become inactive
• Your Aniki will not have access to your bank account, balance, or full transaction history
• You are responsible for obtaining your Aniki's consent before inviting them

If you are an Aniki, by accepting an invitation you consent to receiving SMS alerts from Pausis related to the person who invited you. Standard messaging rates from your carrier may apply.

6. Accuracy and Limitations

Pausis uses automated methods (merchant category codes and keyword analysis) to detect gambling transactions. We strive for accuracy, but:

• False positives may occur (e.g. a restaurant with "casino" in its name)
• False negatives may occur (e.g. gambling through unrecognized channels)
• Pausis does not guarantee detection of all gambling activity
• SMS delivery depends on third-party carriers and may be delayed or fail

Pausis is provided on an "as-is" basis and should be used as one part of a broader accountability strategy.

7. Acceptable Use

You agree not to:

• Use Pausis to monitor another person without their knowledge and consent
• Provide false information during registration or Aniki setup
• Attempt to circumvent, disable, or interfere with the monitoring system
• Use the service for any unlawful purpose
• Reverse-engineer, decompile, or extract source code from the application

8. Data and Privacy

Your use of Pausis is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the service, you acknowledge that you have read and understood the Privacy Policy.

9. Account Deletion and Data Purge

You may request deletion of your account at any time by contacting support@pausis.com or through the in-app account settings. Upon deletion:

• Your bank connection will be revoked
• Your Aniki will receive a final notification
• All personal data will be purged within 30 days, except where retention is required by law

10. Intellectual Property

The Pausis name, logo, application, and website content are the property of Pausis GmbH. You are granted a limited, non-exclusive, non-transferable license to use the application for personal, non-commercial purposes in accordance with these Terms.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• Pausis is not liable for any damages arising from missed, delayed, or false alerts
• Pausis is not liable for the actions or inactions of Anikis based on alerts they receive
• Pausis is not liable for any financial losses, emotional distress, or relationship consequences arising from use of the service
• Our total liability for any claim shall not exceed the amount you paid to Pausis in the 12 months preceding the claim (or CHF 100, whichever is greater)

12. Service Availability

We aim to provide reliable service but do not guarantee uninterrupted availability. We may suspend or modify the service for maintenance, updates, or operational reasons. We will make reasonable efforts to notify you of planned outages.

13. Termination

We may suspend or terminate your account if you violate these Terms. You may stop using Pausis at any time. Sections that by their nature should survive termination (liability, dispute resolution, intellectual property) will remain in effect.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the app or email at least 14 days before they take effect. Continued use after changes take effect constitutes acceptance.

15. Governing Law and Disputes

These Terms are governed by the laws of Switzerland. Any disputes shall be resolved in the competent courts of Switzerland, without prejudice to any mandatory consumer protection provisions that may apply in your country of residence.
